The basis of this bill, HB
4996, the Natural Resources and Environmental Protection Act
was introduced by State Rep. Chris Kolb (D-Ann Arbor) at the request
of the Michigan Environmental Council. It would prevent polluters
from benefiting economically from breaking environmental laws,
bar chronic violators from receiving some state contracts, and
make information on the state's environmental enforcement efforts
publicly accessible.
New York

248 amends the State Constitution to direct the legislature
to create the Office of Public Advocate with authority to bring
civil action against the state or any of its agencies, bureaus
or public authorities to protect public interest in state's natural
and cultural resources. New Jersey Gov. James McGreevey just recently
reinstated his state’s Public Advocate which was abolished by
the previous Todd-Whitman administration.
Rep. Brodsky’s Private
Environmental Law Enforcement Act authorizes any private citizen
who has an interest and is adversely affected by environmental
harms to file a civil suit for any violation of an administrative
or court order compelling an investigation or remediation of an
inactive hazardous waste disposal site.

6207 bars individuals and companies that have violated solid
waste laws from obtaining public contracts or sitting on waste-related
boards and policy-making panels. The length of the ban would vary
according to the seriousness of the violation.

960 funds the Environmental Circuit Prosecutor Project. This
innovative program would make specially trained prosecutors available
to rural local governments who request the assistance. This would
bring the necessary enforcement experience and legal resources
to the local level state-wide. |
