Existing State
Law
New Jersey
In 2001, New Jersey strengthened
their public records law, Title
47 Public Records (47:1A). The law mandates that government
records are to be made available to the public unless they are
determined exempt.
North Carolina
North Carolina passed its Public
Records Law in 1935. This act institutes a policy asserting
that public information compiled by North Carolina agencies is
the property of the people.
Texas
Texas’ law, called the Public
Information Act, is one of the strongest in the country and
provides that each person is entitled, at all times and unless
otherwise expressly provided by law, to complete information about
the affairs of government and the official acts of public officials
and employees.
Virginia
Virginia’s Freedom
of Information Act states that all public records and
meetings are to be presumed open. A recent amendment to the act
established a Freedom of Information Advisory Council to assist
with training and education about the FOIA.
Introduced State
Legislation
Delaware
S
89 would require that all legislative bodies in Delaware be
subject to the Freedom of Information Act requirements. No action
has been taken on this bill since it was introduced on 4/17/2003. |
